The Competition Commission has recommended that the Competition Tribunal approve Harith’s proposed acquisition of FlySafair, subject to conditions aimed at addressing competition concerns.
As Harith also holds a stake in Lanseria Airport, the Commission said the conditions are intended to address concerns arising from the transaction.
The conditions include measures to protect commercially sensitive information and to ensure that airline- and airport-related goods and services at Lanseria Airport are provided to competing airlines on fair and non-discriminatory terms.
Earlier this year, Harith signed a Sale and Purchase Agreement to acquire FlySafair in a transaction that would see the airline move into entirely local ownership. It follows ongoing regulatory and legal challenges over the airline's foreign ownership.
