Court scraps FlySafair licensing dispute deadline

FlySafair has been granted an urgent interdict by the Pretoria High Court, overturning a deadline it was given to fix its ownership structure as part of a sanction issued by the Air Services Licensing Council (ASLC).

At the beginning of this year, the ASLC found that FlySafair was non-compliant with domestic licensing rules as the airline did not meet the Air Services Licensing Act that required 75% of an airline’s voting rights be held by natural persons who are citizens and residents of South Africa. The airline was given until January 23, 2026 to address this.

The airline lodged a formal review of this decision, with the review proceedings to take place after the deadline set by the Council. The court has now suspended that deadline, allowing more time for the review process. A new date is yet to be confirmed, according to a statement by FlySafair.

ASLC issued sanctions based on a technical interpretation of nationality provisions and gave the airline 12 months to comply. This deadline has now been postponed indefinitely.
